On the Ministry of Social Policy of the Nizhny Novgorod Region

1.1. The Ministry of Social Policy of the Nizhny Novgorod Region (hereinafter – the Ministry) was created in accordance with the Law of the Nizhny Novgorod Region dated October 3, 2007 N 129 -Z On the Government of the Nizhny Novgorod Region, by decree of the Governor of the Nizhny Novgorod Region of January 15, 2018 N 6 On approval of the structure executive authorities of the Nizhny Novgorod region.

The Ministry is the successor of the Ministry of Housing Policy and the Housing Fund of the Nizhny Novgorod Region and the Department of Social Protection of the Population, Labor and Employment of the Nizhny Novgorod Region.

1.2. The ministry is:

  • The executive authority of the Nizhny Novgorod region, carrying out a unified state policy in the fields of social protection and social support of the family, women and children, elderly citizens, disabled people, veterans, citizens who suffered from emergency situations, citizens who find themselves in difficult life situations; social services of the population; guardianship and trusteeships regarding adult incompetent or limitedly -capable citizens; disabled rehabilitation; demography; housing relations (hereinafter – the established areas of activity);
  • the authorized executive body of the Nizhny Novgorod region in the field of social services of citizens, including the recognition of citizens in need of social services, as well as on the preparation of an individual program for the provision of social services;
  • the authorized executive body of the Nizhny Novgorod Region for disposing of residential premises of the housing stock of the Nizhny Novgorod Region within its competence;
  • guardianship and guardianship authority in respect of adult citizens permanently residing in the territory of the municipality of the city district of Nizhny Novgorod, recognized by the court as incapable or partially capable, and adult citizens who, for health reasons, cannot independently exercise and protect their rights and perform duties;
  • the authorized executive body of the Nizhny Novgorod region, exercising regional state control (supervision) in the field of social services in the Nizhny Novgorod region.

The Ministry exercises powers in the established areas of activity, including the powers of the Russian Federation transferred to the Nizhny Novgorod Region, both directly and through state institutions of the Nizhny Novgorod Region, the functions and powers of the founder of which are carried out by the Ministry (hereinafter referred to as subordinate institutions).

1.3. The Ministry, when exercising its powers, ensures the priority of the goals and objectives for the development of competition in the commodity markets in the established areas of activity.

1.4. The Ministry is part of the system of executive authorities of the Nizhny Novgorod region, is a legal entity, has a form with the image of the coat of arms of the Nizhny Novgorod region, accounts opened in accordance with the current legislation of the Russian Federation, a seal with the image of the State Emblem of the Russian Federation and with its name, as well as stamps and other details provided by applicable law.

1.5. The legal basis for the activities of the Ministry is: the Constitution of the Russian Federation, federal constitutional laws, federal laws, decrees of the President of the Russian Federation, resolutions of the Government of the Russian Federation, other regulatory acts of the Russian Federation, the Charter of the Nizhny Novgorod Region, laws of the Nizhny Novgorod Region and other regulatory acts of the Nizhny Novgorod Region, as well as this Position.

1.6. The Ministry is subordinate to the Government of the Nizhny Novgorod Region and in its activities is directly supervised by the Deputy Governor of the Nizhny Novgorod Region.

1.7. The Ministry carries out its activities at the expense of the regional budget allocated for its maintenance, on the basis of the budget estimate.

1.8. The Regulations on the Ministry, the structure of the Ministry and the number of employees of the Ministry are approved by the Government of the Nizhny Novgorod Region.

The staffing of the Ministry is approved by order of the Ministry within the annual wage fund and the number of employees approved by the Government of the Nizhny Novgorod Region, the Ministry in agreement with the Deputy Governor of the Nizhny Novgorod Region and the Department of Public Administration and Civil Service of the Nizhny Novgorod Region.

1.9.The property of the Ministry consists of fixed and current assets assigned to it under the right of operational management, financial resources reflected on its independent balance sheet, which are the state property of the Nizhny Novgorod Region.

2. The main tasks of the Ministry

The main tasks of the Ministry are:

Implementation of state policy on the territory of the Nizhny Novgorod region in the established areas of activity, providing, among other things, the necessary conditions for the implementation of the constitutional rights of citizens in the Nizhny Novgorod region, taking into account the economic, national and cultural characteristics of the Nizhny Novgorod region.

2.2. Development of the main directions and improvement of the state policy on the territory of the Nizhny Novgorod region in the established areas of activity of the Ministry.

2.3. Formation and development of an optimal network of state institutions of the Nizhny Novgorod region, the functions and powers of the founder of which are carried out by the Ministry (hereinafter referred to as subordinate institutions), improving the efficiency of their work, coordination and methodological support of their activities.

2.4. Ensuring the constitutional rights of citizens in the Nizhny Novgorod region in the established areas of activity of the Ministry.

Develops and submits, in accordance with the established procedure, for consideration by the Governor of the Nizhny Novgorod Region (hereinafter referred to as the Governor) and the Government of the Nizhny Novgorod Region draft laws of the Nizhny Novgorod Region and other regulatory legal acts on issues within the competence of the Ministry.

3.1.2. Develops state programs within the established areas of activity of the Ministry, including acting as a state customer – coordinator, implements them and prepares reports on implementation, participates in the implementation of activities of other state programs within the competence, prepares reports on their implementation.

3.1.3. Approves administrative regulations for the provision of public services in the established areas of activity of the Ministry.

3.1.4. Participates in the implementation of national projects.

3.1.7. Represents the interests of the Government of the Nizhny Novgorod Region in interaction with federal executive authorities on issues within the competence of the Ministry.

  • establishes state assignments for subordinate institutions;

provides organizational, methodological, information and analytical support for the activities of subordinate institutions;

monitors the compliance of the quality of services actually provided by subordinate institutions with the quality standards of services provided at the expense of the regional budget to the population of the Nizhny Novgorod Region;

coordinates activities and implements personnel policy, contributes to the improvement of the organizational structure and the development of the material and technical base of subordinate institutions;

organizes advanced training and certification of pedagogical workers of subordinate institutions;

ensures fire safety of subordinate institutions;

carries out, within its competence, the formation and development of an optimal network of subordinate institutions, including the development and implementation of measures within the framework of state programs (subprograms) for the construction, reconstruction, overhaul of buildings that are in the operational management of subordinate institutions.

3.1.9. Carries out the functions of the main manager (manager) and recipient of the regional budget funds provided for the implementation of the functions assigned to the Ministry.

3.1.10. Carries out internal financial control over compliance with internal standards and procedures for the preparation and execution of the budget for expenditures, preparation of budget reporting and maintenance of budget accounting by the Ministry and subordinate managers and recipients of budget funds.

Carries out an internal financial audit in order to assess the reliability of internal financial control and prepare recommendations for improving its effectiveness; confirmation of the reliability of budget reporting and compliance of the budget accounting procedure with the methodology and budget accounting standards; preparation of proposals to improve the economy and efficiency of the use of budgetary funds.

3.1.11.Carries out regional state control (supervision) in the field of social services in the Nizhny Novgorod region.

Organizes and conducts inspections of social service providers in accordance with the requirements of the Federal Law of December 26, 2008 N 294-FZ On the protection of the rights of legal entities and individual entrepreneurs in the exercise of state control (supervision) and municipal control.

3.1.12. Evaluates the quality of the provision of socially useful services by socially oriented non-profit organizations in the established field of activity.

3.1.13. Performs the functions of a provider of information on the measures of social protection (support), social services provided within the framework of social services and state social assistance, other social guarantees and payments to the unified state social security information system (hereinafter referred to as the information system), including:

  • places in the information resources of the Ministry used to provide measures of social protection (support), social services within the framework of social services and state social assistance, other social guarantees and payments (hereinafter referred to as information resources), information provided for in Article 6.9 of the Federal Law of July 17, 1999 d. N 178-FZ On State Social Assistance, based on data obtained from segments of information resources of subordinate institutions;
  • provides the information system operator with a list of social protection measures (support), social services provided within the framework of social services and state social assistance, other social guarantees and payments, a list of participants in information interaction and other information for the formation and updating of the classifier of social protection measures (support);
  • provides the information system operator with reports on the use of the information system when working to provide social protection measures (support), social services within the framework of social services and state social assistance, other social guarantees and payments;
  • publishes information about the authority endowed with the authority to post information in the information system authorized to provide social protection measures (support), social services in the framework of social services and state social assistance, other social guarantees and payments;

Provides other necessary information at the request of the information system operator within its competence.

3.1.14. Carries out the functions of the user of the information system in the implementation of activities related to the provision of social protection measures (support), social services in the framework of social services and state social assistance, other social guarantees and payments, in the manner and on the conditions established by the Decree of the Government of the Russian Federation of February 14 2017 N 181 On the Unified State Information System of Social Security.

3.1.15. Carries out checks by recipients of subsidies of conditions, goals and procedure for granting subsidies within the powers.

3.1.16. It exercises control over the execution by local governments of municipal regions, municipal districts and urban districts of the Nizhny Novgorod region of the transferred state powers of the Nizhny Novgorod region.

3.1.17. Ensures the implementation of the Federal Law of February 26, 1997 N 31-ФЗ On mobilization preparation and mobilization in the Russian Federation, regulatory legal acts of the President of the Russian Federation, regulatory legal acts of the Government of the Russian Federation in the field of mobilization training and mobilization.

3.1.18. It takes within its competence measures to comply with the secrecy regime and protect information constituting state secret, as well as other information protected by law.

3.1.19. 3.2. In the field of social protection and social support of certain categories of citizens in the territory of the Nizhny Novgorod region:

3.2.2. 3.2.10. Carries out the provision of material assistance to citizens in difficult life situations in the form of money.

3.2.11. It exercises measures to increase the social status of war veterans, elderly people and citizens dismissed from military service, create conditions for their feasible employment, self -realization, self -employment and self -help, improve health, satisfaction of educational, educational, and cultural needs.

3.2.12. It provides assistance to citizens dismissed from military service, and members of their families, war veterans, military disabilities, veterans of special risk units, family members of the dead military personnel in solving their problematic issues in accordance with the competence of the ministry.

3.2.13. It monitors the provision of social support measures in accordance with regulatory legal acts of the Russian Federation and the Nizhny Novgorod region.

3.2.14. Monitors the socio-economic situation of citizens dismissed from military service and members of their families and exercises measures to social adaptation of citizens dismissed from military service.

3.2.15. It provides the interaction of subordinate institutions and organizations participating in the process of providing social benefits and services for the calculation of monthly monetary compensations for payment of housing and utilities, as well as organizations that deliver social benefits, benefits, subsidies, and compensation to recipients.

It contributes to the development of the system of prevention of violence and cruelty to children in the field of social protection of the population, including through the activities of interdisciplinary commands to assist children affected by violence and cruelty, based on state social services for family and children of the Nizhny Novgorod region.

3.2.33. In the field of social protection and social support of people with disabilities (children with disabilities):

participates within its powers in the social adaptation of disabled people (children with disabilities), including organizing social and environmental rehabilitation, social adaptation of disabled people (children with disabilities), participates in socio-pedagogical, socio-psychological, socio-cultural rehabilitation, in organizing vocational guidance, training of disabled people, in the organization and holding of physical culture and health and sports events in subordinate institutions;

participates within its powers in equipping social infrastructure facilities with special devices and equipment for free movement and access of people with limited mobility;

provides organizational support for the activities of the Council for Veterans and Disabled People under the Governor of the Nizhny Novgorod Region, established by Decree of the Governor of the Nizhny Novgorod Region dated January 23, 2018 N 12;

exercises state control (supervision) over ensuring the availability of social infrastructure facilities and services for disabled people in the implementation of regional state control (supervision) in the field of social services.

3.5.20. Organizes work on the accrual, collection and transfer to the regional budget of citizens' fees for the use of residential premises (rental fees) occupied under social tenancy agreements and residential tenancy agreements for the housing stock of the Nizhny Novgorod Region.

3.5.21. Carries out control over the transfer to the regional budget of rent for residential premises located in the treasury of the Nizhny Novgorod region or in the operational management of the executive authorities of the Nizhny Novgorod region, state public institutions of the Nizhny Novgorod region.

3.5.22. Provides coordination of measures to adapt the living quarters of the disabled and common property in apartment buildings (with the exception of the living quarters of the disabled, which are part of the housing stock of the Russian Federation) taking into account the needs of the disabled in the Nizhny Novgorod region.

3.8. Participates in official inspections in the ministry.

4.28. Exercise other rights in accordance with applicable law and these Regulations.

5.1. The Ministry is headed by a Minister appointed and dismissed by the Governor in accordance with the procedure established by the current legislation.

5.2. The Minister reports to the Governor and Deputy Governor of the Nizhny Novgorod Region.

5.3. The Minister has in his subordination the Deputy Ministers appointed to and dismissed by the Governor in accordance with the procedure established by the current legislation.

5.4. Deputy Ministers represent the Ministry in accordance with the competence of the departments they lead, within the limits of authority determined by the Minister.

5.5.1. Carries out management of the activities of the Ministry on the principles of unity of command and bears personal responsibility for the fulfillment of the tasks and functions assigned to the Ministry.

5.5.2.
